Welcome to WellShape Fitness! These Terms and Conditions (“Terms”) govern your access to and use of the WellShape Fitness mobile application and website (collectively, the “Services”). By downloading, accessing, or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Services.
1. Eligibility You must be at least 14 years old to use our Services. Our app is designed for individuals of all genders. By using WellShape Fitness, you represent and warrant that you meet this age requirement.
2. User Account - You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. - You agree to provide accurate, complete, and updated information when creating an account. - You must notify us immediately if you suspect any unauthorized use of your account.
3. Subscription and Payments - Some features of the Services require a paid subscription. - Subscriptions may be offered on a monthly, quarterly, or yearly basis. - Payments are processed via the Apple App Store or Google Play Store. - Your subscription will automatically renew unless cancelled at least 24 hours before the end of the current period. - You may cancel your subscription through your Apple or Google account settings. - All subscription payments are non-refundable under any circumstances. - Note: In certain jurisdictions, you may have rights under local consumer laws that cannot be waived. 4. License and Intellectual Property - We grant you a non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes. - All content, features, and functionality in the app are the property of WellShape Fitness or its licensors. - You may not reproduce, distribute, modify, or create derivative works without written permission.
5. Health and Safety Disclaimer - The information provided in the app, including workouts and nutrition tips, is for general guidance only. - Always consult a physician or qualified healthcare provider before beginning any fitness or nutrition program. - The content is not intended as medical advice and should not be treated as such. - Use of the app is at your own risk. The user acknowledges that WellShape Fitness, its owners, employees, and affiliates shall not be held liable for any injuries, health issues, or damages that may result from the use of the app. - The user assumes full responsibility for their actions and agrees not to make any claims against WellShape Fitness or its representatives for any harm resulting from the use of the Services.
6. App Features and Functionality - Users can browse workout categories and subcategories, view workout videos, and receive an approximate calorie-burn summary via a popup at the end of each workout. The calorie count is estimated and assigned by the admin based on the nature and intensity of the workout. - The app includes a blog section covering recipes, food, nutrition, and lifestyle content to support user education and engagement. - Smartwatch connectivity is supported, allowing users to sync and view data from their smartwatch within the app.
7. User Conduct You agree not to: - Violate any laws or regulations. - Post or transmit harmful, abusive, defamatory, or obscene content. - Attempt to interfere with or disrupt the Services or servers. - Use bots, scrapers, or other automated means to access the Services.
